§ 1 business area
- By placing the order, the customer ("orderer") accepts the following general terms and conditions of mikono.africa UG (limited liability) ("mikono.africa") for the use of the mikono.africa online shop.


§ 2 Conclusion of Contract and Withdrawal/Right of Withdrawal
- mikono.africa UG (limited liability) is free not to accept orders. The decision is at the discretion of mikono.africa UG (limited liability). If an order is not executed, we will inform the customer of this within a period of 5 working days.
- The offers of mikono.africa UG (limited liability) are non-binding and binding up to the delivery date.
- All verbal, in particular telephone, supplementary speeches, including those relating to the execution of the online order, require separate written confirmation by mikono.africa UG (limited liability) in order to be valid. Our silence on subsequent requests for changes and/or additions means rejection.


§ 3 Delivery
- Unless otherwise agreed, delivery will be made from the production site in Berlin to the delivery address specified by the customer
- Delivery is at the expense and risk of the recipient.
- mikono.africa UG (limited liability) is entitled to deliver the goods in partial deliveries after consultation with the buyer.
- Complaints about deliveries or their calculation can only be asserted within the statutory periods after receipt of the delivery.
- Shipping damage or partial loss must be confirmed by the delivery agent.
- After the delivery period agreed in the order has expired, a subsequent delivery period of 16 days begins. After the expiry of the subsequent delivery period, the withdrawal from the contract is deemed to have taken place, excluding claims for damages.
- The costs of a return that are based on incorrect or incomplete addressing or are due to the customer's refusal to accept will be charged to the customer.
- The withdrawal from the contract according to the above paragraph does not occur if the buyer declares in writing to mikono.africa UG (limited liability) during the subsequent delivery period that he insists on the fulfillment of the contract. However, mikono.africa UG (limited liability) is released from the delivery obligation if the buyer does not respond to our written request within the subsequent delivery period as to whether he insists on the fulfillment of the contract.
- For the punctuality of the delivery, the day the goods are handed over by mikono.africa UG (limited liability) to the shipping company is decisive.
- If the buyer wants to claim damages for non-performance, he must give mikono.africa UG (limited liability) a 4-week deadline in writing, with the threat that he will refuse performance after the deadline has expired. In any case, the amount of compensation is limited to a maximum of 1/3 of the order value.


§ 4 Prices and terms of payment
- All product prices are in euros. All prices are suggested retail prices.
- The invoice total is due and payable when the order is placed. mikono.africa accepts the payment methods shown during the ordering process, such as payment by PayPal, credit card or payment on account. If the customer pays by invoice, the invoice amount is due immediately as advance payment.


§ 5 Warranty / Complaints
- Obvious, particularly visible defects in the delivered goods, including transport damage, must be reported in writing immediately upon delivery, but no later than 1 week after receipt, with a precise description.
- mikono.africa UG (limited liability) is only obliged to accept returned goods to check for defects if the buyer has previously announced the return in writing, stating the invoice number and invoice date.
- If there is a defect in the purchased item for which mikono.africa UG (limited liability) is responsible, the buyer can either request subsequent performance by way of remedying the defect or replacement delivery within a period of 20 working days. If mikono.africa UG (limited liability) is not willing or able to remedy the defect/replacement due to disproportionality or if this is delayed beyond a reasonable period of time for reasons for which mikono.africa UG (limited liability) is responsible or proposes in any other way If the defect is not remedied/replacement delivered, the buyer is entitled to choose to withdraw from the contract or to demand a corresponding reduction in the purchase price.
- In the event of transport damage, the goods must be left in the condition they were in when the damage was discovered.
- Unless otherwise stated below, further claims by the customer - regardless of the legal grounds - are excluded. mikono.africa UG (limited liability) is not liable for damage that has not occurred to the delivery item itself; In particular, mikono.africa UG (limited liability) is not liable for lost profits or other financial losses on the part of the customer. Insofar as the liability of mikono.africa UG (limited liability) is excluded, this also applies to the personal liability of employees, representatives and vicarious agents.
- The above limitation of liability does not apply if the damage was caused intentionally or through gross negligence or if there was personal injury. Furthermore, it does not apply if the customer asserts claims under Sections 1, 4 of the Product Liability Act or claims for faulty defects in accordance with Sections 437 of the German Civil Code. The same applies to initial inability or impossibility for which we are responsible.
- If mikono.africa UG (limited liability) negligently violates an essential contractual obligation, mikono.africa UG (limited liability) is limited to the damage that typically occurs.


§ 6 Interruption of delivery, withdrawal
- In the event of force majeure, official measures, as well as operational disruptions through no fault of our own, which have lasted or are expected to last longer than a week, the delivery period or acceptance period will be extended without further ado by the duration of the hindrance, but no longer than 5 weeks plus additional delivery period. The extension does not occur if mikono.africa UG (limited liability) does not immediately inform the buyer of the reason for the hindrance as soon as it can be seen that the aforementioned deadlines cannot be met.


§ 7 Applicable Law and Place of Jurisdiction
- German law applies to the exclusion of the UN purchase law.

If the buyer does not have a general place of jurisdiction in Germany or if he moves his place of residence or place of business or his usual place of residence outside of the Federal Republic of Germany after the conclusion of the contract or his place of residence or place of business or his usual place of residence is not known at the time the action is filed, this remains the case However, mikono.africa UG (limited liability) reserves the right to sue the buyer at his place of jurisdiction.


§ 8 Severability Clause

The invalid or unenforceable provision is to be replaced by an effective or enforceable provision in accordance with its meaning.
